Attorney Misconduct
Are you facing the Disciplinary Board of the Pennsylvania Supreme Court?
In the state of Pennsylvania, the Disciplinary Board of Pennsylvania has sole jurisdiction over the conduct/alleged misconduct of attorneys. If you have received a complaint and you will be facing the Disciplinary Board, it is important that you have the proper defense.
A member of the Colgan & Associates, LLC legal team has experience handling these types of cases as a former member of the Disciplinary Board of the Pennsylvania Supreme Court. During Attorney Hershey's six years as a Committee Member and Chair, he handled cases involving client neglect, theft, mishandling of estates, requests for reinstatement and suspensions of attorneys disabled because of drug and/or alcohol abuse.
Protect Yourself
Attorney Hershey is now accepting clients being investigated for possible misconduct (violation of the Rules of Professional Conduct). In some cases, the prosecuting attorneys within the Office of Disciplinary Counsel will agree to a potential settlement in lieu of litigation. In those cases, both the Disciplinary Board and Supreme Court will review the recommendation of the parties before the recommendation can be made final. Mr. Hershey will be handling these cases on an hourly fee.
Examples of situations in which an attorney has violated the Rules of Professional Conduct could include the following:
- Client Neglect - failing to respond within a timely manner; failure to file documents within the necessary time period.
- Misuse of Funds - the attorney uses client's funds for his or her own use.
- Conflict of Interest - the attorney continues to work or begins working with a client despite the presence of a conflict of interest.
Attorney Hershey is fully prepared to examine the circumstances surrounding your complaint and/or disciplinary action in order to give you the best chance at a positive outcome. It is important that you protect yourself against overzealous punishment and inaccurate claims or complaints.
