Statutory Definition – Simple Possession

Pursuant Section 780-113(a)(16) of The Controlled Substance, Drug, Device, and Cosmetic Act, it is unlawful for a person to knowingly or intentionally possessing a controlled or counterfeit substance.


The maximum penalty for a conviction of simple possession of drugs is 1 year. Additionally, a conviction for this offense carries a mandatory six (6) month license suspension for a first offense and the period of license suspension escalates for each subsequent conviction.
