Statutory Definition – Simple Possession
Pursuant Section 780-113(a)(16) of The Controlled Substance, Drug, Device, and Cosmetic Act, it is unlawful for a person to knowingly or intentionally possessing a controlled or counterfeit substance.
The maximum penalty for a conviction of simple possession of drugs is 1 year. Additionally, a conviction for this offense carries a mandatory six (6) month license suspension for a first offense and the period of license suspension escalates for each subsequent conviction.
It’s Not That “Simple”
In Pennsylvania, when a person is accused of possessing certain drugs, like cocaine, heroin, or ecstasy, in a small amount for personal use, the offense is commonly referred to as “simple possession of drugs.” However, reference to this offense as “simple possession,” does not diminish the severity of the consequences you could face upon conviction.
